Legal bases for particiaption in the giveaway
1.- ORGANIZING COMPANY OF THE PROMOTION
The company Escoda Sabatés S.L. with address at Carrer de Joaquín Costa, 47, 08206 Sabadell, Barcelona and identified with the number B58288697 organizes the Evolution giveaway (hereinafter, "the Promotion") of international scope, to be developed through the Internet, in accordance with the provisions of the Participation requirements section. The purpose of this raffle is to reward the loyalty of the brand's followers by raffling some of their products, concretely the Black Travel Set and the Watercolour Journal A5 (vertical). In addition, in collaboration with Aletheia Acuarelas the raffle will include a 6 half-pan palette.
2.- START DATE AND END DATE
The Promotion will start on November 20, 2023 at 1:00 p.m. CET, and will end on November 24, 2023 at 00:00 CET.
3.- PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS
The participation requirements will be the following: - People residing in any country in the world and over 18 years of age may participate. - Some countries will be excluded due to their current sociopolitical situation as shippings are not possible: Ukraine, Russia, Israel, Palestine. - Only those Participants who are holders of an Instagram account may participate. – Participants must follow @escoda_brushes and @aletheia.acuarelas on Instagram for their participation to be valid - Participants must comment on the brand's publication on the Instagram social network tagging 2 friends during the participation period. - Participants may only participate with a single Instagram profile. If it is detected that a Participant participates with several Instagram profiles, they will be disqualified. - The application will accumulate mentions and hashtags of the same Participant even if they are in different comments.
4.- PROMOTION CONDITIONS AND PRIZES
The winner will be chosen through the Random.org platform randomly. The winner will be announced on November 27th through the brand's social profiles. The prize will consist of a art material pack which includes: 1 unit of Escoda Black Travel Set, 1 unit of Watercolour Journal A5 (portrait) and Aletheia Acuarelas 6 half-pan palette. The prize cannot be exchanged for cash or any other prize, nor can it be subject to change or alteration. The Company reserves the right to modify the prize if, on the day of declaring the participant as a winner, there are stock problems and, therefore, it is impossible to give said prize. The winner may contact the Company during a period of 7 days from the date on which it is announced on the social profile of the brand. In the event that such contact does not occur within the stipulated period, the giveaway will be carried out again to obtain a new winner. The holding of the draw, as well as the awarding of the prize are subject to current tax regulations.
5.- DISQUALIFICATIONS AND PENALTIES
If it is evident that any of the Participants does not meet the requirements set forth in the Bases, or the data provided to participate is not valid, their participation will be considered void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded by virtue of this Promotion.
6.- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions whose content is considered inappropriate, that are offensive, insulting or discriminatory or that could violate the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honor, personal and family privacy and self-image will not be allowed either. We will not be responsible for the damages caused by the comments made by the Participants in the Promotion, and that at any time could hurt the sensitivity of other Participants. Participation in this Promotion, as well as the publication of the comments made by the Participants in the publications, may not under any circumstances violate the Instagram Community Rules or the Instagram Conditions of Use. If the use of fraudulent means for participation, such as the use of bots in comments, is discovered by the Company, the prize will not be awarded to you and will remain the property of the Company.
7.- EXEMPTION OF LIABILITY
By way of example, but not limitation, we are not responsible for possible losses, thefts, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the Participant regarding the prize you get from this Promotion. We do not assume responsibility in cases of force majeure or fortuitous events that could prevent the promotion from taking place or the total or partial enjoyment of the prize. In the event that this Promotion could not be carried out, either due to fraud detected in it, technical errors, or any other reason that is not under the control of the Company and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend it, including the participation web page.
8.- PROTECTION OF PERSONAL DATA
The company responsible for the processing of your data is Empresa Escoda Sabatés S.L. with address at Carrer de Joaquín Costa, 47, 08206 Sabadell, Barcelona and identified with the number B58288697. In accordance with the provisions of the General Data Protection Regulation, each participant with the acceptance of these Legal Bases consents that their personal data be incorporated into a file, owned by it, with the purpose of managing the giveaway, as well as disseminating and publicize their results, and process the delivery of the prize. We inform you that you can exercise your rights of Access, Rectification, Deletion, Opposition, Limitation of treatment, Portability, oblivion and not to be subject to automated individual decisions by sending an e-mail to info@escoda.com, attaching a copy of a identification document. Without prejudice to any other administrative appeal or judicial action, the Participant shall have the right to file a claim with a Control Authority, in particular in the Member State in which they have their habitual residence, place of work or place of the alleged infringement, in in the event that you consider that the processing of your personal data is not adequate to the regulations, as well as in the event that the exercise of your rights is not satisfied. That is why the Participant declares to have been informed of the conditions on protection of personal data by accepting and consenting to the treatment.
9.- CHANGES AND ACCEPTANCE
We reserve the right to modify or extend these promotional bases, to the extent that it does not harm or impair the rights of the Participants in the Promotion. The mere fact of participating in the giveaway implies that the Participant fully accepts the conditions of these Legal Bases. Likewise, participation in a draw of this nature implies acceptance of the rules of the Instagram social network through which it is carried out.
10.- APPLICABLE LAW AND JURISDICTION
These legal bases will be governed in accordance with Spanish law. The Courts and Tribunals of the Participant's city of residence will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or compliance with these bases.
